How is your complaint examined?

After the Court has received your initial application, it will examine it to see if your application is complete and if it is admissible. There is no time period when the Court has to decide on the admissibility of your complaint. However, it usually takes 2-4 months to accept or reject your complaint.  

If the Court decides to reject your application, you cannot appeal this decision.

If your application is accepted, it will be placed on a list until it has its turn to be examined. When the Court examines your application it will request the public authority that is accused of having abused your human rights to give its response to your complaints. The Court may also ask you to provide additional observations or information.

The Court usually examines cases in written proceedings without an oral hearing. Although the law requires an oral hearing, the Constitutional Court may waive the oral hearing with the consent of the parties to the proceedings, if there can be no further clarification of the case during that hearing. This happens in most cases.

How long will it take?

The full examination of your application after accepting it within the admissibility stage, can take about 4-10 months depending on the factual and legal complexity of the case and the conduct of the parties. In more complex cases it may take longer.
